1. Who these terms are with
DayWell is provided by Tom Harris, trading as DayWell ("DayWell", "we", "us"), a sole trader based in the United Kingdom. By creating an account, you agree to these terms. Questions can be sent to tomjohnharriscoaching@gmail.com.
2. DayWell is in closed beta
You're using DayWell during an early, closed beta. That means:
- Features may change, break, or be removed with little notice.
- We test thoroughly, but bugs are more likely than in a finished product.
- We take reasonable care to protect your data, but recommend keeping your own copies of anything irreplaceable (e.g. original scans of important documents) rather than relying on DayWell as your only copy while it's in beta.
- We may contact you directly for feedback about your experience.
3. Your account and household
- You must be 18 or over to create a DayWell account and household.
- You're responsible for keeping your login details secure and for activity that happens under your account.
- As a household owner, you're responsible for who you invite into your household and what's stored there. Household members can see and manage shared household content unless a feature (like the Vault) restricts it further.
- Content about other people — including children — should only be added by an adult with the right to do so.
4. Subscriptions and billing
- DayWell offers a free plan and paid plans with additional features. Current pricing and any free trial length are shown in the app before you subscribe.
- Paid plans are billed automatically on a recurring basis (typically monthly) via Stripe until you cancel.
- You can cancel anytime from the Subscription page, which opens Stripe's Customer Portal. Cancelling stops future billing; you keep paid features until the end of the period you've already paid for.
- If a payment fails, we'll attempt to notify you and may downgrade your household to the Free plan if it isn't resolved.
- Because DayWell is a digital service, once you've started using paid features with your consent, your statutory right to a 14-day cooling-off period under the Consumer Contracts Regulations 2013 may not apply in full. Outside of that, refunds are considered on a case-by-case basis — contact us if something's gone wrong with a charge.
5. Your content
You own the content you upload to DayWell — documents, events, tasks, lists, and everything else your household adds. By uploading it, you give us the limited permission needed to store it, process it, and show it back to you and your household (and, where you choose to use an AI feature, to send the relevant text to our AI provider so it can be interpreted). We don't use your content for advertising or to train AI models.
You're responsible for making sure you have the right to upload anything you add to DayWell, and for not uploading anything illegal, infringing, or that you don't have permission to share with your household.
6. AI features
Features like Brain Dump, shopping-list parsing, and document extraction use AI to interpret what you type or upload. AI can misread dates, names, or details. Always check anything AI-generated — especially events, tasks, and reminders — before relying on it. DayWell's AI features are for household organisation only, not professional, legal, financial, or medical advice.
7. Acceptable use
Please don't use DayWell to:
- Break the law, or upload unlawful, abusive, or infringing content.
- Try to gain unauthorised access to another household's data or to DayWell's systems.
- Interfere with the service (for example, attempting to overload or disrupt it).
- Resell or provide DayWell to others as your own service.
We may suspend or close an account that breaches this section.
8. Ending your account
You can delete your household at any time from Settings. This permanently deletes your household's data and cancels any active subscription — it can't be undone. We may also suspend or close accounts that breach these terms or that are inactive for an extended period, giving reasonable notice where practical.
9. Liability
We work to keep DayWell reliable and secure, but during beta in particular, we can't guarantee uninterrupted or error-free service. To the fullest extent permitted by law, DayWell is provided "as is," and we aren't liable for indirect or consequential losses (such as lost profits or lost data) arising from your use of it. Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that can't lawfully be limited or excluded.
10. Changes to these terms
We may update these terms as DayWell develops. If we make a material change, we'll let you know by email or an in-app notice before it takes effect. Continuing to use DayWell after a change takes effect means you accept the updated terms.
11. Governing law
These terms are governed by the laws of England and Wales, and any dispute will be subject to the exclusive jurisdiction of the courts of England and Wales. If you're a consumer living elsewhere in the UK, you may also be able to bring proceedings in your local courts.
